Mink, the KING is breaking the law I guess you don't understand this. SEN. JOHN MCCAIN, R-ARIZ.: Hey, look, you just can't make these things up. The incredible politicization of everything that this administration does. The Warren Act requires it. I mean, there is no gray area that requires that layoff notices be extended 60 days before the layoffs. That was so people could be prepared for losing their jobs. So, they now-- the Department of Labor, after some time ago saying they had no jurisdiction, are now saying that that doesn't have to be done. And again, you know, everybody has a record. But again, let me just tell you a quote from Barack Obama, Senator Barack Obama on 7/17/07, there was a threat of some layoffs in Illinois, and then-Senator Obama said, "The least employers can do when they are anticipating layoffs is to let workers know they are going to be out of a job and a paycheck with enough time to plan for their future." Well, Obama said, "We must give the Warren Act teeth to insure that workers are not left in the lurch without a job or a paycheck." And look, the effects will be devastating. It is a fight between the three branches of government as to how to eliminate the sequestration and guess who is AWOL -- missing in action. And that's the president of the United States who has decided that it's not his problem. It is his problem as commander in chief to take care of our nation's security. Would you vote for your boss if he told your getting fired? In these difficult economic times, many companies are considering layoffs and even plant closings, even government. The Worker Adjustment and Retraining Notification Act (WARN) protects workers, their families, and communities by requiring most employers with 100 or more employees to provide notification 60 calendar days in advance of plant closings and mass layoffs. Employee entitled to notice under WARN include managers and supervisors, as well as hourly and salaried workers. WARN requires that notice also be given to employees' representatives, the local chief elected official, and the state dislocated worker unit. Advance notice gives workers and their families some transition time to adjust to the prospective loss of employment, to seek and obtain other jobs, and, if necessary, to enter skill training or retraining that will allow these workers to compete successfully in the job market. Generally, WARN covers employers with 100 or more employees, not counting those who have worked less than six months in the last 12 months and those who work an average of less than 20 hours a week. Employees entitled to advance notice under WARN include managers and supervisors as well as hourly and salaried workers. Regular federal, state, and local government entities that provide public services are not covered by WARN. The Department of Labor's (DOL) Employment and Training Administration (ETA) administers WARN at the federal level, and some states have plant closure laws of their own. A State Dislocated Worker Unit Coordinator can provide more information on notice requirements in a specific area. DOL has no enforcement role in seeking damages for workers who did not receive adequate notice of a layoff or received no notice at all. I counted 60 days from the end of the year (Dec. 31) and it lands on on November 2, by Federal law that OBAMA help pass. Now the election is on the sixth of November. So Obama is holding up sending pinks for the layoffs notices that takes place at years end.

The Budget Control Act of 2011 famously established a bipartisan congressional “Super Committee” to come up with $1.2 trillion in budget cuts over the next decade. Alas, to the surprise of no one, the Super Committee couldn’t make even that modest commitment to fiscal restraint, so the grim machinery of “sequestration” growled to life, enforcing a series of mandatory budget cuts – which hit the military harder than any other single sector of the government.
The military employs a lot of private-sector contractors, and those contractors employ a lot of people. They’ll have to cut tens of thousands of jobs because of sequestration, effective January 2, 2013.
There happens to be a law called the Worker Adjustment and Retraining Notification Act, dating back to 1988, which “offers protection to workers, their families and communities by requiring employers to provide notice 60 days in advance of covered plant closings and covered mass layoffs.”
Who’s covered by this law? “In general, employers are covered by WARN if they have 100 or more employees, not counting employees who have worked less than 6 months in the last 12 months and not counting employees who work an average of less than 20 hours a week. Private, for-profit employers and private, nonprofit employers are covered, as are public and quasi-public entities which operate in a commercial context and are separately organized from the regular government. No joecocker, I still don't understand why the GOP would question govt. job layoffs (they don't believe in "BIG" government)......although I have a feeling it has to do with the fact those jobs are connected with the military, not to mention President Obama has spoken.

Let the law suits began after the election. I hope the ones knowing that their layoffs are coming vote correctly.

Solyndra Settle With Fired Ex-Workers for $3.5 Million
Solyndra LLC, the bankrupt solar- panel maker that received a $535 million U.S. Energy Department loan guarantee, reached a $3.5 million settlement with former workers who claimed they received inadequate layoff notices.
The settlement will resolve allegations that the company failed to give employees 60 days’ notice under the Worker Adjustment and Retraining Notification Act when it fired most of its 1,100 workforce on Aug. 31, just before seeking bankruptcy court protection last year.
Solyndra will set up a $3.5 million fund to be distributed to the workers two weeks after the settlement is effective, according to court papers. The settlement was jointly proposed by Solyndra and the ex-employees.
“In light of the inherent risks and costs associated with litigation of the WARN actions,” the company has “determined that the proposed settlement of the WARN claims is fair and well within the range of reasonableness,” Solyndra said in settlement papers filed Aug. 10.
Solyndra faced as much as $15 million in damages plus attorney’s fees if the workers succeeded, according to court documents.
The solar-panel maker said the agreement is also fair to workers because without it they would have to “wait years for any payment” on their claims.
